SAN ANTONIO, Texas – Atrium Roofing, a San Antonio roofing contractor and Owens Corning Platinum Preferred partner, is urging homeowners to understand what Texas law allows and prohibits when a roofer gets involved in an insurance claim. The warning comes in response to a pattern of misleading contractor practices across the Central Texas market.
“After every storm season, homeowners tell us the same thing. A contractor showed up, promised to handle the whole claim, and offered to cover the deductible,” said Jose Puente, owner of Atrium Roofing and a civil engineer. “Most people don’t know that both of those offers can be illegal in Texas.”
The Law
Chapter 4102 of the Texas Insurance Code sets a clear boundary. A roofing contractor cannot act as a public insurance adjuster on a claim where the contractor is also doing the repair work. The Texas Supreme Court upheld that rule in June 2024 in Texas Department of Insurance v. Stonewater Roofing. The court ruled that the ban covers professional conduct, not protected speech.
HB 2102 took effect September 1, 2019. It makes it a Class B misdemeanor for a contractor to waive, rebate, or absorb a homeowner’s insurance deductible.
Despite these laws, many roofing companies across the Texas market advertise that they will file claims, negotiate with insurers, or handle the entire claim process on behalf of the homeowner.
Where the Line Actually Falls
Most homeowners don’t know what a roofer is legally allowed to do during a claim. According to the Texas Department of Insurance, a contractor can:
- Inspect the roof and document damage
- Provide an estimate
- Attend the adjuster’s on-site meeting to walk through findings
- Discuss supplements and scope clarifications with the homeowner’s insurer
- Perform the approved repair or replacement
A contractor cannot:
- Act as the homeowner’s agent in negotiating the claim settlement
- Promise to recover a specific dollar amount
- Advertise or hold themselves out as a public insurance adjuster
- Waive, absorb, or rebate any portion of the deductible
“There’s a difference between a roofer explaining the scope of work to an adjuster and a roofer negotiating your claim settlement,” Puente said. “One is our job. The other requires a public adjuster’s license, and for good reason.”
Red Flags for Homeowners
Atrium Roofing identifies several warning signs that a contractor may be crossing legal boundaries:
- Promises to “handle the entire claim” or act as the homeowner’s “advocate” in insurance negotiations
- Offers to cover, absorb, or waive the deductible
- Pressure to sign a contract before the adjuster’s visit
- Language claiming the company has “insurance adjusters on staff” who will negotiate the claim
Homeowners who need claims advocacy beyond what a roofer can legally provide should hire a licensed public insurance adjuster. Public adjusters are regulated by TDI and are prohibited from also performing the repair work on the same property.
